Understanding Immigration Law in Portugal

It is important to clarify that short-stay visas — Schengen visas and similar categories — are not, under the current legal framework, suitable instruments for regularisation purposes, subject to limited exceptions provided for under applicable law. Therefore, anyone wishing to reside in Portugal must apply for a residence visa in their country of origin or departure to Portugal.

Once the residence visa has been granted by the Portuguese consular services in the applicant's country of origin or habitual residence, the subsequent step is to schedule an appointment with the Agency for Integration, Migration and Asylum (AIMA) in order to convert the residence visa into a residence permit.

The legal framework governing these procedures is established by Law No. 23/2007, of 4 July, which regulates the entry, stay, departure, and removal of foreign nationals from Portuguese territory.
