It is essential for applicants to seek specialist legal counsel to maximise the prospects of a successful application. Lawful residence in Portugal requires a structured and technically accurate approach, which typically involves multiple steps, including: a comprehensive assessment of the client’s factual and legal circumstances; proper legal classification of the client’s immigration status — such as employee, student, family member of a Portuguese national, investor, retiree, or highly qualified professional, among other legally defined categories; and other necessary procedures tailored to the client’s specific situation.
Given the technical nature of Portuguese immigration procedures and the discretionary elements often involved in administrative practice, professional legal assistance plays a decisive role in mitigating procedural risks, preventing avoidable refusals, and ensuring full compliance with the applicable regulatory framework.
In Portugal, in order for a foreign national to remain in a lawful situation, they must fall within one of two legal categories: (i) holder of a residence visa; or (ii) holder of a residence permit.
It is important to clarify that short-stay visas — Schengen visas and similar categories — are not, under the current legal framework, suitable instruments for regularisation purposes, subject to limited exceptions provided for under applicable law. Therefore, anyone wishing to reside in Portugal must apply for a residence visa in their country of origin or departure to Portugal.
Once the residence visa has been granted by the Portuguese consular services in the applicant's country of origin or habitual residence, the subsequent step is to schedule an appointment with the Agency for Integration, Migration and Asylum (AIMA) in order to convert the residence visa into a residence permit.
The legal framework governing these procedures is established by Law No. 23/2007, of 4 July, which regulates the entry, stay, departure, and removal of foreign nationals from Portuguese territory.
In addition, It should also be noted that AIMA has implemented an online portal through which most appointment scheduling procedures are now carried out.
The above summary is intended for general informational purposes only and does not replace a formal legal consultation aimed at assessing the client's specific factual and legal circumstances.
